Cadder v HMA: The Implications for Police Officers Facing Allegations of Criminal Conduct
The full extent and effect of the decision of the Supreme Court in Cadder v HM Advocate [2010] UKSC 43; 2010 SLT 1125, issued on 26 October 2010,is yet to be understood. The decision has had important implications for many who find themselves in the category of a “suspect”. Included within this group are police officers who are the subject of a complaint alleging criminal conduct and are the subject ofa subsequent investigation, which would involve the Deputy Chief Constable and a report to both the Procurator Fiscal and Crown Office with regards to whether or not criminal proceedings should be taken against the officer.
